Critical analyses of the audit profession have become more common in recent years. Many of these analyses focus on the entire audit profession in developing their criticisms and concerns. In this paper, the scope of analysis is narrowed to examine in depth the auditing profession's use of the concepts of reasonable assurance and materiality in audit performance and audit communications. Reasonable assurance and materiality are the terms that auditors use to describe the scope of their responsibility to the public. Similarly, (...) reasonable assurance and materiality are the key determinants of audit effort. An overview of official guidance, practitioner reports, and academic research reveals that these two key concepts are not well specified nor are they consistently applied in audit practice. These findings are evaluated from two competing perspectives on professions – the traditional, functionalist perspective and the critical theorists' perspective. Evaluation from the latter perspective leads to a conclusion that the profession's use of these key terms to guide practice and communication leaves the profession open to charges of mystification and unjustified paternalism. Inspired by the success of generative linguistics and transformational grammar, proponents of the linguistic analogy (LA) in moral psychology hypothesize that careful attention to folk-moral judgments is likely to reveal a small set of implicit rules and structures responsible for the ubiquitous and apparently unbounded capacity for making moral judgments. As a theoretical hypothesis, LA thus requires a rich description of the computational structures that underlie mature moral judgments, an account of the acquisition and development of these structures, and an (...) analysis of those components of the moral system that are uniquely human and uniquely moral. In this paper we present the theoretical motivations for adopting LA in the study of moral cognition: (a) the distinction between competence and performance, (b) poverty of stimulus considerations, and (c) adopting the computational level as the proper level of analysis for the empirical study of moral judgment. With these motivations in hand, we review recent empirical findings that have been inspired by LA and which provide evidence for at least two predictions of LA: (a) the computational processes responsible for folk-moral judgment operate over structured representations of actions and events, as well as coding for features of agency and outcomes; and (b) folk-moral judgments are the output of a dedicated moral faculty and are largely immune to the effects of context. In addition, we highlight the complexity of the interfaces between the moral faculty and other cognitive systems external to it (e.g., number systems). We conclude by reviewing the potential utility of the theoretical and empirical tools of LA for future research in moral psychology. (shrink)

SARS, like HIV, placed healthcare workers at risk and raised issues about the duty to treat. But philosophical accounts of the duty to treat that were developed in the context of HIV did not adequately address some of the ethical issues raised by SARS. Since the next epidemic may be more like SARS than HIV, it is important to illuminate these issues. In this paper, we sketch a general account of the duty to treat that arose in response to HIV. (...) Our purpose is not to defend or criticise this account, but to show that it needs to be developed in order to address three important issues. The first issue concerns how risks should be distributed among healthcare professionals. The second issue concerns the conflicts that arise between professional duties and family duties. The third issue concerns the forms of support that societies owe healthcare workers during epidemics. Our descriptions of these issues are drawn from our experience of the SARS epidemic in Taiwan. OBJECTIVES: To study the accuracy of reviewing ward notes (chart review) as a measure of the quality of care rendered to patients with "Do Not Resuscitate" (DNR) orders. DESIGN: We reviewed the charts of 19 consecutive, competent inpatients with DNR orders for evidence that the staff addressed a broad range of patient care needs called Concurrent Care Concerns (CCCs), such as withholding treatments other than resuscitation itself, and attention to patient comfort needs. We then interviewed the patient, consultant physician, house (...) officer, and primary nurse and compared the ward notes with the understandings of these staff members. SETTING: The medical service of an urban university medical centre. RESULTS: The average number of documented CCCs addressed per DNR order was 1.1. The ward notes generally agreed with the perceptions of patients, house officers, and nurses (% agreement with notes = 79%, 77%, and 82%; kappa = 0.43, 0.40, 0.50). Consultant physicians' understandings were poorly reflected in the ward notes (% agreement = 59%; kappa = 0.18). They overestimated attention to CCCs compared with the notes (P < 0.0001) and with other observers (P < 0.0001). CONCLUSION: Chart review for attention to CCCs accurately reflects the understandings of patients, house officers, and nurses, but consultant physicians report more attention to CCCs than is recorded in the ward notes or understood by other observers. Better communication regarding end-of-life care plans should be encouraged. (shrink)

Development of the knowledge base for a profession depends on research and scholarship that builds on the insights and work of scholars within the discipline and is disseminated through the literature. The purpose of this study was to examine a unique collection of 79 articles selected by editors as representative of their nursing journals. Articles were assessed for congruence with long‐standing values and conceptual definitions of nursing, and the extent to which they built on prior literature published in nursing. Articles (...) were scored based on whether they reflected four characteristics of nursing as a discipline (holism, social context, goal of health, and consistency with common definitions of nursing); an abstract score on the extent to which the title, abstract, or keywords indicated a general focus on nursing; and a distinction score based on whether the article distinguished nurses or nursing from other providers. Fifty of the articles received an article score of 4, indicating all four disciplinary characteristics were present in the article's content. While the majority of the articles were congruent with fundamental nursing values and perspectives, only 28% of the sources cited were from nursing sources. The lack of citations to nursing literature, coupled with an assessment that reveals gaps in substantive content that builds on nursing knowledge, raises questions about the future of nursing perspectives in the literature. BackgroundReconciling results obtained using different types of sensory measures is a challenge for autism sensory research. The present study used questionnaire, psychophysical, and neurophysiological measures to characterize autistic sensory processing in different measurement modalities.MethodsParticipants were 46 autistic and 21 typically developing 11- to 14-year-olds. Participants and their caregivers completed questionnaires regarding sensory experiences and behaviors. Auditory and somatosensory event-related potentials were recorded as part of a multisensory ERP task. Auditory detection, tactile static detection, and tactile spatial resolution psychophysical thresholds were (...) measured.ResultsSensory questionnaires strongly differentiated between autistic and typically developing individuals, while little evidence of group differences was observed in psychophysical thresholds. Crucially, the different types of measures appeared to be largely independent of one another. However, we unexpectedly found autistic participants with larger auditory Tb ERP amplitudes had reduced hearing acuity, even though all participants had hearing acuity in the non-clinical range.LimitationsThe autistic and typically developing groups were not matched on cognitive ability, although this limitation does not affect our main analyses regarding convergence of measures within autism.ConclusionOverall, based on these results, measures in different sensory modalities appear to capture distinct aspects of sensory processing in autism, with relatively limited convergence between questionnaires and laboratory-based tasks. Generally, this might reflect the reality that laboratory tasks are often carried out in controlled environments without background stimuli to compete for attention, a context which may not closely resemble the busier and more complex environments in which autistic people’s atypical sensory experiences commonly occur. Sensory questionnaires and more naturalistic laboratory tasks may be better suited to explore autistic people’s real-world sensory challenges. Further research is needed to replicate and investigate the drivers of the unexpected association we observed between auditory Tb ERP amplitudes and hearing acuity, which could represent an important confound for ERP researchers to consider in their studies. En reliant l’analyse de la structure contradictoire et analogisante de l’imaginaire social aux perspectives antérieurement développées sur “la liberté selon l’espérance,” notre propos vise à expliciter ses enjeux émancipateurs. Les apories auxquelles les médiations symboliques contraignent l’agir doivent nourrir (...) la double nécessité d’un “devoir de vigilance” et d’une “timide espérance”: telle est à la fois la difficulté irréductible et la force critique de l’analyse ricœurienne de l’imagination socialisante. The role of individual factors in behavioral neuroscience is an important, but still neglected, area of research. For example, the Elevated Plus-Maze Test has been one of the most used paradigms to gauge unconditioned aversively motivated behavior in rodents. However, despite a great number of experiments with this test there have been only few efforts to assess systematic individual variations in the elevated plus-maze and related neurobiological functions. The present review aims to give, first, a general overview and introduction about (...) the test, and second, an animal model of anxiety based on natural variance of plus-maze behavior within a given unselected population of rats. Finally, critical aspects of such approaches in animal research are discussed, and suggestions are given as to where to go from here. (shrink)

A partir d'un thème, d'une question ou d'un corpus, chacune remet en question l'opposition tranchée entre sensation et intellect, entre rationalité et affectivité.

La notion de mythe, dont la fortune a été brillante en sociologie, en anthropologie et en psychanalyse, ne peut laisser le juriste indifférent. Assurément, l'idée de rapprocher ces deux domaines peut paraître singulière, tant ils paraissent éloignés. Cependant, cette apparente altérité mérite d'être revisitée. Le retour au mythe, à travers une grille de lecture juridique, autorise une mise en perspective de la rationalité juridique contemporaine. Chaque mythe antique est en rapport avec la fondation du droit. Mais, le droit positif a (...) lui-même une dimension mythologique importante. En raison de sa fonction normative, il est pétri d'imaginaire et de fictions. Or, à une époque comme la nôtre, où les mythes et autres métarécits sont déconsidérés, assimilés à une pensée préscientifique, il faut peut-être reconnaître que ce sont ces métarécits qui donnent du sens et qui peuvent renforcer la légitimité du droit dans sa dimension instituante. Le droit ne peut conserver sa fonction anthropologique sans renouer avec ce qui le sous-tend, à savoir le mythe. (shrink)

Inspired by early-nineteenth-century discoveries about heat transfer, the French physicist Claude Pouillet measured the influx of solar radiation at the earth and, in 1838, asked what these observations revealed about the temperature of the sun and of space itself. At about the same time, the British natural philosophers John Herschel and J. D. Forbes made similar measurements in order to better understand the sun's influence on climate. This paper tells how and why Pouillet, Herschel and Forbes made the first estimates (...) of the solar constant, estimates which would acquire new importance with the discovery of the laws of thermodynamics by the mid century. The repetition bears what Derrida will later, in Glas, call his siglum, his abbreviation or acronym, the semanticization of his initials, D.Ja., which shows up in the common adverb déjà, “already.” Countersignature is a response to the other's writing, the other's signing. Which (...) is to say another name for it is reading, but one that figures an act of responsible response, signed and countersigned. To conclude, this chapter considers a text from 1998 that sustains a reflection on the history of, if not Derrida's signature, then an invention signed by Derrida. Those who have read me, in particular those who have read “Paul de Man’s War,” know very well that I would have quite easily accepted a genuine critique, the expression of an argued disagreement with my reading of de Man, with my evaluation of these articles from 1940-42, and so on. After all, what I wrote on this subject was complicated enough, divided, tormented, most often hazarded as hypothesis, open enough to discussion, itself discussing itself enough in advance for me (...) to be able to welcome questions, suggestions, and objections. Provided this was done so as to demonstrate and not to intimidate or inflict wounds, to help the analysis progress and not to score points, to read and to reason and not to pronounce massive, magical, and immediately executor verdicts. Five of the six “responses” that I reread last night are written, as one used to say, with a pen dipped in venom. Less against the de Man of 1940-42, perhaps, then against me . Less against me, in truth, than against “Deconstruction” . How can the reader tell that these five “critical responses” are not “responses,” critical texts or discussions, but rather the documents of a blinded compulsion? First of all, the fact that they are all monolithic. They take into account none of the complications of which my text, this is the very least one can say, is not at all sparing. They never seek to measure the possibility, the degree, or the form, as always happens in an honest discussion, of a partial agreement on this or that point. No, everything is rejected as a block; everything is a block and a block of hatred. Cet article porte sur les aspects non communicationnels du métier des professionnels de la traduction. Les différents métiers de la traduction exigent des compétences linguistiques en réalité très diversifiées. Des données récentes, notamment d’Europe et d’Amérique du Nord, démontrent l’importance du « secteur des services linguistiques ». Si l’on dispose assez largement de statistiques fiables sur l’ampleur du marché de la traduction dans les pays développés, on n’en a pratiquement aucune pour les pays en voie de développement, même les plus (...) grands. Nous savons très peu de choses des conditions de travail des traducteurs, mais une récente étude européenne montre qu’en général les traducteurs littéraires sont mal payés et souvent soumis à de lourdes charges de travail, ce qui nuit à la qualité. D’autres études sont manifestement nécessaires. La Fédération internationale des traducteurs vise à promouvoir le professionnalisme des métiers de la traduction et l’amélioration des conditions de travail des traducteurs en rassemblant les diverses associations nationales. Néanmoins, les instances dirigeantes de cette fédération sont dominées par l’Europe et les États-Unis alors même que l’on assiste à l’émergence de nouvelles puissances sur la scène mondiale et que les besoins en traduction ne cessent d’augmenter : ce sont de tels déséquilibres que l’article entend également aborder.This article looks into the non-communicational aspects of the work of translating professionals. Translators work in a variety of jobs that require a range of language skills. Recent data, particularly from Europe and North America, demonstrate the economic importance of the “language services industry”. Reliable statistics on the size of the labour market are available principally from developed countries, but there is a lack of such data on even the largest developing countries. We know very little about the working conditions of translators; however, a recent European survey indicates that, in general, literary translators are poorly paid and frequently required to take on heavy work loads, with negative consequences for quality. More studies are clearly necessary. As a forum for national translators’ associations, the International Federation of Translators promotes professionalism in the translating field and proper working conditions for translators. However, the FIT’s governing bodies are dominated by Europe and North America, despite the rise of the new economic powers and the increase in demands for translation. This paper also discusses some of the consequences of these imbalances. (shrink)

Le réductionnisme scientiste a privé le monde de ce qui avait été un univers enchanté, empli des formes et des esprits qui hantaient le monde médiéval. Merleau-Ponty et Husserl dans son œuvre tardive tentent de réenchanter la nature, mais du point de vue de la perception. Leur insistance sur la structure et la forme perceptuelles est un moyen de protection contre le réductionnisme et donc, en un sens, réenchante le monde qui, pour parler comme Merleau-Ponty, est « con­damné au sens (...) ». Être « con­damné au sens », cela signifie être forcé de reconnaître à nos réalisations rationnelles les plus abouties, à nos actes visant à relier ce qui est séparé à partir d’une relationalité déjà perçue, une dépendance génétique (ou Fundierung ) par rapport à des événements de niveau inférieur, pré-rationnels, dans lesquels le soi est présent de façon latente. Être « con­damné au sens » signifie que les réalisations logiques et rationnelles pleinement articulées doivent, pour être dotées de sens, être ramenées à des structures proto-rationnelles dans le champ de la perception. Que Merleau-Ponty et Husserl révèlent la sphère pré-prédicative comme une sphère de simple signification, ce fait reflète une critique commune de l’empirisme. Le monde partiellement réenchanté est un monde conditionné par des horizons de signification qui sont de réels aspects du monde à décrire. Je fais valoir que la perception optimalement monstrative atteint les choses mêmes dans leur télos monstratif où elles se montrent le mieux. Je conclus avec quelques remarques sur la manière dont cette conception du réenchantement mobilise la philosophie de John McDowell, qui est, malgré lui, un partisan de la structure dans le champ perceptuel. The thesis we develop in this essay is that all humans are endowed with a moral faculty. The moral faculty enables us to produce moral judgments on the basis of the causes and consequences of actions. As an empirical research program, we follow the framework of modern linguistics.1 The spirit of the argument dates back at least to the economist Adam Smith (1759/1976) who argued for something akin to a moral grammar, and more recently, to the political philosopher John Rawls (...) (1971). The logic of the argument, however, comes from Noam Chomsky’s thinking on language specifically and the nature of knowledge more generally (Chomsky, 1986, 1988, 2000; Saporta, 1978). If the nature of moral knowledge is comparable in some way to the nature of linguistic knowledge, as defended recently by Harman (1977), Dwyer (1999, 2004), and Mikhail (2000; in press), then what should we expect to find when we look at the anatomy of our moral faculty? Is there a grammar, and if so, how can the moral grammarian uncover its structure? Are we aware of our moral grammar, its method of operation, and its moment-to-moment functioning in our judgments? Is there a universal moral grammar that allows each child to build a particular moral grammar? Once acquired, are different moral grammars mutually incomprehensible in the same way that a native Chinese speaker finds a native Italian speaker incomprehensible? How does the child acquire a particular moral grammar, especially if her experiences are impoverished relative to the moral judgments she makes? Are there certain forms of brain damage that disrupt moral competence but leave other forms of reasoning intact? And how did this machinery evolve, and for what particular adaptive function? We will have more to say about many of these questions later on, and Hauser (2006) develops others. However, in order to flesh out the key ideas and particular empirical research paths, let us turn to some of the central questions in the study of our language faculty.. (shrink)

These tended to be more hands-on people and thus, in my understanding at least, had a more particular relationship with things in their world than others for whom objects were examples of types of things.This brief vignette serves as an introduction to my qualified enthusiasm for the project taken up by Allison Mitchell in her paper, "Taking Mentality Seriously: A Philosophical Inquiry into the Language of Addiction and Recovery" (Mitchell, 2006). Indeed, as a practicing psychiatrist I would be hard pressed not to endorse the use of language as a key to deeper aspects of experience.My following remarks are mostly contra Mitchell's hypothesis, but before beginning I name one more reason I think this project is worthwhile. In spite of much research and recitations of the motto "treatment works," we do not presently have a reliable treatment for addiction. The linguistic portrait painted by Mitchell allows us to view our treatments in vivo and reflect upon what we see. (For the purpose of this commentary, I consider alcoholism and Alcoholics Anonymous [AA] as a general example of addiction and treatment.)Medication treatment remains almost inconsequential except when applied for comorbid psychiatric disorders rather than the primary addiction. Even then it rarely serves to undo some form of self-medication, but instead only offers an important leg up in battling the addiction.Research and much experience has shown AA to be the single best treatment for alcoholism (Vaillant and Hiller-Sturmhofel 1996). Some investigators have proposed underlying mechanisms for its efficacy (some, like "creating dependency" run very counter to Mitchell) (Vaillant 2005). AA's success is highly dependent upon attendance (McCrady et al. 2004), which can of course be a marker for getting better in the first place and not solely a cause of improvement (i.e., people who are doing better attend more meetings not vice- versa). Even within AA, the dropout rate is quite high (Martin et al. 1996). Workers in this area [End Page 223] have raised questions about AA's approach and have proposed other avenues to sobriety, including interpersonal, cognitive–behavioral, and relapse prevention programs (Witkiewitz and Marlatt 2005, 2004; O'Dwyer 2006). Lamentably, some very large studies failed to show any effective ability to match up alcoholics with a particular treatment modality (Church 2004; Read 2004).Given the lack of clarity with which we still work, I think an approach like Mitchell's is a welcome call for serious reflection. The limitations of a linguistic analysis place an unfortunate constriction on implications to be drawn.Mitchell's chief concern is that the language of recovery, as reflected in twelve-step programs, betrays and even fosters a degree of passivity, which leaves the addict without an adequate sense of agency and autonomy with which to combat addiction. From a more philosophical perspective, Mitchell believes this is due to an incomplete philosophical materialism; one that lacks "mentality" (i.e., the sense that part of our physical being is made up of mental activities such as emotions, motivations, beliefs, etc.). This attitude is manifest in a "pretheoretic conception of the self" that leaves the addict with a dearth of self-awareness as a mental agent of action and change.In place of the standard recovery model in use today, Mitchell suggests cultivating a sense of self that values and fosters engaged agency that is both capable of self-control and responsive to external obligations.A Few ConcernsFirst, I will offer a few concerns about premises at work within the paper. This paper reports on an investigation of issues surrounding the use of ethical codes/codes of conduct in Irish based companies. Using a comprehensive questionnaire survey, the paper examines the incidence, content and enforcement of codes of conduct among a sample of the top 1000 companies based in Ireland. The main findings indicate that the overall usage of codes of conduct amongst indigenous Irish companies has increased significantly from 1995 to 2000. However, in line with prior research, these codes focus primarily (...) on issues surrounding company and employee protection as opposed to society protection. Almost half of all codes are written by company personnel or provided by head office. Revisions of codes are common but formal ongoing methods of instructing new staff about codes are not prevalent. Less than one-third of companies with codes have formal channels for reporting violations but a high percentage have formal disciplinary procedures in place for breaches of codes. (shrink)

In Luce Irigaray's thought, Socrates is a marginal figure compared to Plato or Hegel. However, she does identify the Socratic dialectical position as that of a ‘phallocrat’ and she does conflate Socratic and Platonic philosophy in her psychoanalytic reading of Plato in Speculum of the Other Woman. In this essay, I critically interpret both Irigaray's own texts and the Platonic dialogues in order to argue that: the Socratic dialectical position is not ‘phallocratic’ by Irigaray's own understanding of the term; that (...) Socratic philosophy should not be conflated with the mature Platonic metaphysics Irigaray criticizes; and that Socratic dialectical method is similar in some respects with the dialectical method of Diotima, Socrates’ instructress in love and the subject of Irigaray's “Sorcerer Love” essay in An Ethics of Sexual Difference. Nurses working in a newborn intensive care unit report that treatment decision disagreements for infants in their care may lead to ethical dilemmas involving all health-care providers. Applying Rest’s Four-Component Model of Moral Action as the theoretical framework, this study examined the responses of 224 newborn intensive care unit nurses to the Nurses Ethical Involvement Survey. The three most frequent actions selected were as follows: talking with other nurses, talking with doctors, and requesting a team meeting. The multiple regression analysis (...) indicates that newborn intensive care unit nurses with greater concern for the ethical aspects of clinical practice (p =.001) and an increased perception of their ability to influence ethical decision making (p =.018) were more likely to display Nurse Activism. Future research is necessary to identify other factors leading to and inhibiting Nurse Activism as these findings explained just 8.5% of the variance. (shrink)
